03-23-30018 Bay St Properties Environmental Remediation

Sealed bids will be received by the Port of Bremerton in its Administration office at 8850 SW State Hwy 3, Bremerton, Washington 98312, until February 26, 2025, at 2:00 PM for construction project entitled, "03-23-30018 Bay Street Properties Environmental Remediation".  Any bids received after cannot be considered.  The Port is not responsible for courier delays. A public bid opening will take place at the Airport Conference Room following the receipt of bids.

The work to be performed under this contract consists of completing excavation, underground storage tank removal, and in-situ groundwater treatment activities in accordance with Section 5: Remediation Contractor Specifications in the Interim Action Work Plan for 521 and 525 Bay Street in Port Orchard, Washington, prepared by PIONEER Technologies Corporation in May 2024, and incorporated into this solicitation. The construction estimate is $350,000.00.

The building structures at 521 and 525 Bay St. have been removed with utilities disconnected and was solicited separately.

A pre-bid site visit is scheduled for January 29, 2025, at 10:00 AM at the site address of 521-525 Bay. St in Port Orchard, WA 98366.

PREVAILING WAGE: All contractors and subcontractors performing work on a construction project funded through this Contract shall comply with prevailing wage laws by paying the higher of state or federal prevailing wages according to:

  • State Prevailing Wages on Public Works, Chapter 39.12 RCW, as applicable to the Project funded by this contract, including but not limited to the filing of the "Statement of Intent to Pay Prevailing Wages" and "Affidavit of Wages Paid" as required by RCW 39.12.040. The Contractor shall maintain records sufficient to evidence compliance with Chapter 39.12 RCW, and shall make such records available for Board's review upon request;
  • The Davis Bacon Act, 40 USC 276a-276a-5 and related federal acts provide that all laborers and mechanics employed by contractors or subcontractors in the performance shall be paid wages at rates not less than those prevailing on similar construction in the locality as determined by the Secretary of Labor.

This contract will be funded, in part, by a grant from the Environmental Protection Agency. As such, it will be subject to Federal requirements described throughout the Bidding documents.

The Port of Bremerton, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises (DBE) will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.

Each bid shall be accompanied by a cashier's check, money order, or bid bond made payable to the Port of Bremerton, in an amount not less than five percent (5%) of the amount of the base bid. Said check or bid bond shall be given as a guarantee that the bidder shall execute such contract as may be awarded to it in conformity with its bid and with the contract documents, and shall provide surety bonds as specified therein with ten (10) days after notification of the award of contract. 

The Port of Bremerton reserves the right to reject any or all bids, and waive irregularities or informalities in the bid or in the bidding. 

No bidder may withdraw its bid after the hour set for the opening thereof or before award of contract, unless bid award is delayed for a period exceeding forty-five (45) days.

Questions will be complied and responses, if warranted, issued in the form of an addendum. No addenda shall be issued less than three (3) working days prior to the bid due date, or the bid due date will be pushed out at least seven (7) days.

 

BIDDER RESPONSIBILITY CRITERIA: The contract will be awarded to the party submitting the "lowest responsible proposal," subject to any products and/or vendor preferences provided by applicable Washington State laws, taking into consideration the quality of the articles proposed to be supplied, their conformity with specifications, and the purposes for which required. The Port may reject any and all proposals.

In determining "lowest responsible proposal," in addition to price and other factors outlined above, the following criteria are used in determining the lowest responsible proposal:

  1. At the time of bid submittal, have a certificate of registration in compliance with chapter 18.27 RCW;
  2. Have a current state unified business identifier number;
  3. If applicable, have industrial insurance coverage for the bidder's employees working in Washington as required in Title 51 RCW; an employment security department number as required in Title 50 RCW; and a state excise tax registration number as required in Title 82 RCW;
  4. Not be disqualified from bidding on any public works contract under RCW 39.06.010 or 39.12.065(3);
  5. Have completed or be exempt from the L&I required public works training per 39.04.350 and RCW 39.06.020,
  6. Within the three-year period immediately preceding the date of the bid solicitation, not have been determined by a final and binding citation and notice of assessment issued by the department of labor and industries or through a civil judgment entered by a court of limited or general jurisdiction to have willfully violated, as defined in RCW 49.48.082, any provision of chapter 49.46, 49.48, or 49.52 RCW.
